Terms of Service for JAPAN International Clinic

本規約 (以下「本規約」) は、一般社団法人 SIG (以下「当法人」) が提供する JAPAN International Clinic サービス (https://japan-international-tokyo.com/lp/visitors/ 含む。以下「本サービス」) の利用条件を定めるものです。本サービスを利用するすべてのお客様 (以下「ユーザー」) は、本規約に同意のうえ本サービスをご利用いただくものとします。
These Terms of Service ("Terms") govern the use of the JAPAN International Clinic service (including https://japan-international-tokyo.com/lp/visitors/, collectively the "Service") provided by 一般社団法人 SIG ("Provider"). All users of the Service ("Users") must agree to these Terms before using the Service.

第 1 条 (適用) / Article 1. Scope

本規約は、ユーザーと当法人との間の本サービスに関する一切の関係に適用されます。本サービスを利用した時点で、ユーザーは本規約に同意したものとみなされます。
These Terms apply to all matters relating to the Service between the User and the Provider. By using the Service, the User is deemed to have agreed to these Terms.

第 2 条 (サービス内容) / Article 2. Services

本サービスは、当法人が提携する医療機関 (以下「提携クリニック」) における診療予約、診療料金の決済 (オーソリ・ノーショー料金徴収を含む)、および関連情報提供を行うプラットフォームです。
The Service is a platform operated by the Provider that handles appointment booking, payment processing (including authorization and no-show fee collection), and related information for consultations at partner medical institutions ("Partner Clinics").

医療行為そのものは、各提携クリニックの医師資格保有者が、当該クリニックの責任において実施します。当法人は予約および決済の取次を行うものであり、医療行為自体の責任は負いません。
The actual medical examinations and treatments are performed by licensed physicians at each Partner Clinic, under that clinic's own responsibility. The Provider acts as an intermediary for booking and payment, and does not bear responsibility for the medical care itself.

第 3 条 (利用登録および予約) / Article 3. Booking

ユーザーは、本サービス上の予約フォームに必要事項を入力し、有効なクレジットカードによる本人認証 (¥0 SetupIntent) を完了することで予約申込ができます。当法人または提携クリニックが当該予約を承諾した時点で予約が成立します。
Users may submit a booking by completing the booking form and successfully authorizing a valid credit card (via a ¥0 SetupIntent). The booking is concluded when the Provider or Partner Clinic accepts the request.

医療上の判断、提携クリニックの都合、またはその他の合理的な理由により、当法人または提携クリニックは予約申込を承諾しない場合があります。その場合、ユーザーへの請求は発生しません。
The Provider or Partner Clinic may decline a booking request based on medical judgment, clinic availability, or other reasonable grounds. In such cases, no charge will be made to the User.

第 4 条 (料金および支払) / Article 4. Fees and Payment

本サービスにおける料金は予約フォームおよび「特定商取引法に基づく表記」ページに記載のとおりとします。決済は Stripe, Inc. を通じてクレジットカードで行います。
Fees are as set forth on the booking form and on the "Notice based on the Act on Specified Commercial Transactions" page. Payments are processed by credit card via Stripe, Inc.

(1) 予約時 / At booking: ¥0 SetupIntent (カード認証のみ、実請求なし) / Card authorization only, no charge.
(2) 診療時 / At consultation: 診療料金は提携クリニックにて精算 / Consultation fees are settled at the Partner Clinic.
(3) キャンセル/ノーショー時 / On cancellation or no-show: 第 5 条のとおり ¥11,000 のキャンセル料金が登録カードに自動課金されます / A ¥11,000 cancellation fee is automatically charged to the registered card as set forth in Article 5.

第 5 条 (キャンセルおよび変更) / Article 5. Cancellation and Changes

ユーザーは予約時刻の 30 分前まで、マイページから無償で予約のキャンセルまたは日時変更を行うことができます。予約時刻の 30 分前以降のキャンセルおよび予約時刻にお越しいただけなかった場合 (ノーショー) には、¥11,000 のキャンセル/ノーショー料金を申し受けます。
Users may cancel or reschedule free of charge up to 30 minutes before the appointment time, via the management page. Cancellations made within 30 minutes of the appointment, or no-shows, will incur a ¥11,000 cancellation / no-show fee.

診療開始後の返金は原則としてお受けしておりません。
Refunds are not generally available once the consultation has started.

第 6 条 (禁止事項) / Article 6. Prohibited Conduct

ユーザーは、本サービスの利用にあたり、以下の行為を行ってはなりません。
Users shall not engage in the following while using the Service:

(1) 法令または公序良俗に違反する行為 / Acts violating laws or public order and morals
(2) 犯罪行為に関連する行為 / Acts related to criminal activity
(3) 当法人または提携クリニック、第三者の知的財産権、肖像権、プライバシー、名誉その他の権利または利益を侵害する行為 / Acts infringing the intellectual property, image rights, privacy, reputation, or other rights of the Provider, Partner Clinics, or third parties
(4) 本サービスの運営を妨害する行為 / Acts interfering with the operation of the Service
(5) 不正な目的をもった予約申込、なりすまし、虚偽情報の登録 / Booking with fraudulent intent, impersonation, or registering false information
(6) その他、当法人が不適切と判断する行為 / Other acts deemed inappropriate by the Provider

第 7 条 (本サービスの提供の停止等) / Article 7. Suspension of Service

当法人は、システム保守、災害、通信障害、その他やむを得ない事由により、ユーザーへの事前通知なく本サービスの全部または一部の提供を一時的に停止することがあります。これによりユーザーまたは第三者に生じた損害について、当法人は一切の責任を負いません。
The Provider may suspend all or part of the Service without prior notice for system maintenance, disasters, network failures, or other unavoidable reasons. The Provider shall not be liable for any damage suffered by the User or any third party as a result of such suspension.

第 8 条 (免責事項) / Article 8. Disclaimer

医療行為の結果、効能、診断および治療内容に関する責任は、当該医療行為を実施した提携クリニックに帰属します。当法人はこれらに関して一切の責任を負いません。
Responsibility for the outcome, efficacy, diagnosis, and content of medical care lies with the Partner Clinic that performs the care. The Provider bears no responsibility for these matters.

当法人は、本サービスに事実上または法律上の瑕疵 (安全性、信頼性、正確性、完全性、有効性、特定の目的への適合性、セキュリティ等に関する欠陥、エラーやバグ、権利侵害などを含みます) がないことを明示的にも黙示的にも保証しておりません。
The Provider does not, expressly or impliedly, warrant that the Service is free from defects in fact or law (including defects regarding safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors or bugs, and infringement of rights).

第 9 条 (個人情報の取扱) / Article 9. Personal Information

当法人は、本サービスの利用によって取得する個人情報を、別途定める「プライバシーポリシー」に従って取り扱います。
Personal information obtained through the use of the Service is handled in accordance with the separately established Privacy Policy.

第 10 条 (利用規約の変更) / Article 10. Changes to Terms

当法人は、必要と判断した場合、ユーザーへの事前の通知なく本規約をいつでも変更できるものとします。変更後の規約は本ページに掲示した時点から効力を生じます。
The Provider may modify these Terms at any time without prior notice to Users when deemed necessary. The amended Terms take effect upon posting on this page.

第 11 条 (準拠法および管轄裁判所) / Article 11. Governing Law and Jurisdiction

本規約の解釈にあたっては、日本法を準拠法とします。本サービスに関して当法人とユーザーとの間で紛争が生じた場合には、当法人の本店所在地を管轄する裁判所を専属的合意管轄とします (東京地方裁判所)。
These Terms shall be governed by and interpreted in accordance with the laws of Japan. Any disputes arising between the Provider and a User regarding the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Provider's head office (Tokyo District Court).
